Update - Greendale Village Shopping Centre
I’ve been contacted by a number of local residents regarding the Greendale Village Shopping Centre development.
I can confirm the development application (DA) for the Greendale Village Shopping Centre has not lapsed and is still current.
I am sorry this news is probably a shock, as I previously advised the DA would lapse on 14 October 2023.
As you may be aware, on 11 November 2021 an extension to the currency period was issued by the State Planning & Environment Court under section 86 (s86) of the Planning Act 2016 (the Act) extending the validity of the DA until 14 October 2023.
What residents (and Council officers) were unaware of was that on 29 June 2021 the State Planning Minister declared a ‘COVID-19 emergency applicable event’.
The Planning Minister has the power to declare an ‘applicable event’ under section 275E of the Act. The Minister effectively extended all Development Applications which were current between 29 April 2022 to 24 June 2022 by one year.
As a result, the currency period for the Greendale Way Development Application has been extended by an additional 12 months, which means it is effective until 14 October 2024.
I’m afraid this land is private property and Council does not have the power to compel a property owner to build an approved development. The land is zoned for a shopping centre and Council will stand firm on this.
Essentially, we must now wait for the developer to either exercise their right to build Greendale Village Shopping Centre as originally intended, or for the DA to lapse on the 14th of October in 2024.
